Elite Fitness Free Gym With Purchase
Terms & Conditions
1.Claimant's must:
Purchase and pay in full one of the
selected promotional products instore, marked with the
FREE GYM tag,("Selected Products")
from an authorised Elite Fitness retailer during the
Promotional Period (see clause 8).
The Promoter is not responsible for deliveries of Selected
Products that are late, lost or
stolen.
2. $85 for delivery and
fulfillment to be paid when submitting the claim in accordance with
Clause 3.
3.To claim, if the Selected Product
is not on back order follow steps (i) below, or if the
Selected Product is on back order
follow step (ii) below:
(i) Mail Claim: fully complete the
manual claim form found in-store including the full name,
postal address, valid email address,
invoice number of the qualifying Selected Product,
store
and date of purchase, $85 payment
for delivery (payment made by either credit card, cash or
cheque) and mail the completed claim
form together with a copy of the original invoice of the
Selected Product and payment details
to Elite Fitness Equipment, PO BOX 98803 Manukau
City. within 14
days of the purchase date of the Selected Product. Claimants will receive a
phone call or email from the
Promoter confirming receipt of their claim. Details on the method
of payment of $85 for delivery and
fulfillment must be filled out correctly on the manual claim
form. Payment will be processed once
the purchase receipt has been received and
validated.
(ii) Back ordered products means,
the situation where the order has been placed and paid for
during the Promotional Period, but
the Selected Product has not been delivered by the
manufacturer to the retailer. In the
event of a claimant waiting on a back order, the claimant
must pay in full for their Selected
Product during the Promotional Period.
(iii) Manual back order claim: fully
complete the manual claim form found in-store, providing
all required details including the
invoice number (Claimants must tick the relevant tick box to
acknowledge the Selected Product is
on back order) and including $85 payment for delivery
and fulfillment (payment made by
either credit card, cash or cheque on the claim form) and
mail the claim form together with
the payment details to Elite Fitness Equipment, PO BOX
98803 Manukau City. within 14 days
of the purchase date of the Selected Product.
Claimants must then follow the
instructions provided to finalise their claim once the product
has been delivered and the invoice
number obtained.
4. Commercial or business
transactions involving the purchase of the Selected Products,
lay-by's and rental transactions are
excluded from this offer ("Excluded Transactions"). The
Promoter at its sole discretion
shall have the right to refuse any claim for any Excluded
Transaction.
5. Purchases of the Selected
Product via “Trademe” or similar online third party Internet
websites are also excluded from this
offer ("Excluded Purchase") The Promoter at its sole
discretion shall have the right to
refuse any claim for any Excluded Purchase.
6. All redemption claims
must be posted within 14 days of the date of the purchase receipt
from the participating retailer.
Dated post stamps will be checked. Claim forms must be
received by last mail April 30th 2010 otherwise they will be deemed to be invalid.
Invalid
claims will not be eligible to
receive the gift specified in clause 14. The Promoter accepts no
responsibility for claims not
processed or late or declined claims due to incorrect payment
details.
7. Instructions on how to
claim the gift form part of these Terms and Conditions. Participation
in this Promotion is deemed
acceptance of these Terms and Conditions. This Promotion is
not
valid in conjunction with any other
offer or promotion involving Elite Fitness
products.
8. The promotional period
commences on 26th December 2009 and concludes on 30th April
2010 at 5.00pm ("Promotional
Period"). The Promoter in its absolute discretion reserves the
right to extend the Promotional
Period. Any such extension shall be notified by the Promoter
at any time on the Promotional
website and on selected point of sale material.
9. Subject to clauses 4 and
5 this Promotion is open to all New Zealand residents. Claimants
are required to purchase and pay in
full for any of the Selected Products instore to redeem the
Free Gym, Multiple gift redemptions
are permitted, provided that each is associated with an
individual purchase of a Selected
Product through a participating retail outlet within New
Zealand and each gift redemption
entry is submitted separately for each purchase and includes
a separate payment of $85 for
delivery and fulfillment for each claim, in accordance with these
Terms and
Conditions.
10. The Promoter reserves the right,
at any time, to verify the validity of the gift redemption and
the claimant's details (including
the claimant's identity and place of residence) and to
disqualify
any claimant who submits a gift
redemption that is not in accordance with these Terms
and
Conditions or who tampers with the
gift redemption process. The Promoter reserves the right
to contact the participating stores
to determine when the Selected Products are delivered by
the participating retail outlet in
New Zealand when back order claims are submitted in
accordance with Clause 3 (ii) and
(iii). Errors and omissions will be accepted at the Promoter's
discretion. Failure by the Promoter
to enforce any of its rights at any stage does not
constitute
a waiver of those
rights.
11. If there is a dispute as
to the identity of a claimant, the Promoter reserves the right, in its
sole discretion, to determine the
identity of the claimant.
12. Any incomplete, indecipherable,
or illegible submission of a redemption claim will be
deemed
invalid.
13. The Promoter's decision
is final on all matters in this Promotion and no correspondence
will be entered
into.
14. All claimants who submit a valid
gift redemption in accordance with these Terms and
Conditions will each receive a Free
Gym valued at $699.95. The value of the gift is a
guide
only and was correct at the time of
printing. The Promoter accepts no responsibility for any
discrepancy in gift
value.
15.The Promoter shall use all
reasonable efforts to ensure that all approved claims will be
fulfilled by registered post within
eight (8) weeks from the time the redemption is
received,
along with the original purchase
receipt.
16. If a claimant has
received a Free Gym through this Promotion and requires customer
support or assistance or has an
enquiry relating to the warranty of the Free Gym, claimants
are to contact their local Elite
Fitness retail store or call 0800 2 GET FIT.
17. If the gift is unavailable, the
Promoter, in its discretion, reserves the right to substitute
the gift with another gift of equal
value.
18. The gift is not transferable or
exchangeable and cannot be redeemed as cash.
19. If this Promotion is interfered
with in any way or is not capable of being conducted as
reasonably anticipated due to any
reason beyond the reasonable control of the Promoter, the
Promoter reserves the right, in its
sole discretion, to the fullest extent permitted by law, to
disqualify any claimant; or to
modify, suspend, terminate or cancel this Promotion, as
appropriate.
20. Except for any liability that
cannot be excluded by law, the Promoter (including its officers,
employees, agents and contractors)
excludes all liability (including negligence), for any
personal injury, or any loss or
damage (including loss of opportunity), whether direct,
indirect,
special or consequential, arising in
any way out of this Promotion, including, but not limited to,
where arising out of the following:
(a) any technical difficulties or equipment malfunction
(whether or not under the Promoter's
control); (b) any theft, unauthorised access or third party
interference; (c) any entry that is
late, lost, altered, damaged or misdirected (whether or not
after their receipt by the Promoter)
due to any reason beyond the reasonable control of the
Promoter; (d) any variation in gift
value to that stated in these Terms and Conditions; (e) any
tax
liability incurred by a claimant;
or (f) use of the gift.
21. The Promoter shall not be
responsible for any delays in supply of the gift to the
participant
as a result of the failure by the
supplier of the Free Gym to supply the number of units within the
time specified to the Promoter. The
Promoter shall additionally not be responsible for any delays
caused as a result of inbound
transportation, disruptions (including but not limited to strikes, weather,
postage delays etc) which are caused
by events, which are beyond the control of the Promoter
and/or the supplier of the
gift.
22. The Promoter collects
personal information in order to conduct the Promotion. Entry is
conditional on providing this
information. The Promoter may, for an indefinite period unless
otherwise
advised, use the information for
promotional, marketing and publicity purposes including sending
electronic. Entrants should direct
